These Terms govern your access to and use of Foodoogle and its related services.
Acceptance of These Terms
These Terms of Service govern your access to and use of Foodoogle, including its websites, applications, content, features, and related services. By accessing or using Foodoogle, creating an account, or purchasing a subscription, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
Eligibility and Accounts
You must be legally capable of agreeing to these Terms. If you use Foodoogle on behalf of an organization, you represent that you have authority to bind that organization. You are responsible for providing accurate account information, safeguarding your login credentials, and all activity under your account. Notify us through the Contact or Support page if you suspect unauthorized access.
Limited License and Ownership
Foodoogle grants you a personal, limited, non-exclusive, non-transferable, revocable license to use the Services for lawful, non-commercial purposes in accordance with these Terms. Foodoogle and its licensors retain all rights in the Services, including software, design, branding, text, graphics, and other content. These Terms do not transfer any ownership rights to you.
Acceptable Use
You may not misuse the Services; violate any law or another person’s rights; interfere with security or operation; attempt unauthorized access; introduce malicious code; scrape, copy, reverse engineer, resell, or exploit the Services except where applicable law expressly permits; submit unlawful or harmful content; or use automated systems in a manner that burdens the Services. We may investigate suspected misuse and restrict access where reasonably necessary.
Health and Nutrition Disclaimer
Foodoogle provides ingredient, nutrition, calorie, allergen, and health-related information for general educational and informational purposes only. The Services do not provide medical advice and are not intended to diagnose, treat, cure, or prevent any disease. Foodoogle is not a substitute for professional medical advice, diagnosis, or treatment. Always verify product labels and consult a qualified healthcare professional regarding allergies, health conditions, dietary needs, or medical decisions. In an emergency, contact local emergency services.
Product Information and Analysis
Product formulations and labels can change, and information from manufacturers, users, databases, artificial intelligence, or other providers may be incomplete, delayed, or inaccurate. Scores, warnings, comparisons, and recommendations are estimates and may not reflect your individual circumstances. You are responsible for confirming ingredients, allergens, nutrition facts, serving sizes, and other important information directly from current packaging or the manufacturer before consuming or purchasing a product.
User Submissions
You retain ownership of information, images, feedback, and other material you intentionally submit. You grant Foodoogle a limited, worldwide license to host, process, reproduce, and transmit that material only as reasonably necessary to operate, improve, secure, and provide the requested Services. You represent that you have the necessary rights to submit the material and that it does not violate law or another person’s rights.
Subscriptions, Billing, and Cancellation
Paid subscriptions, prices, billing intervals, and included features are described at checkout. Subscriptions may renew automatically until canceled. You authorize our payment provider to charge the applicable recurring amount and taxes using the payment method provided at checkout. You may manage or cancel through the options available in Foodoogle. Cancellation prevents future renewals and generally takes effect at the end of the current paid period. Fees already charged are non-refundable except where required by law or expressly stated at purchase.
Third-Party Services
Foodoogle may rely on or link to third-party services, databases, payment providers, and content. Their services are governed by their own terms and privacy practices. We do not control and are not responsible for third-party availability, content, security, accuracy, or conduct. Your use of third-party services is at your own risk.
Privacy
Our Privacy Policy explains how Foodoogle collects, uses, shares, protects, and retains information. By using the Services, you acknowledge the practices described in that policy.
Service Availability and Changes
We may add, remove, update, suspend, or discontinue features or the Services, and may impose reasonable usage limits. We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free. Where reasonably practicable, we will provide notice of material changes that significantly affect paid features.
Disclaimer of Warranties
To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. Foodoogle disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
Limitation of Liability
To the fullest extent permitted by law, Foodoogle and its affiliates, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, revenue, profits, goodwill, or business interruption arising from or related to the Services. To the fullest extent permitted by law, total liability for any claim will not exceed the greater of the amount you paid Foodoogle during the twelve months before the event giving rise to the claim or one hundred U.S. dollars. These limits do not apply where prohibited by law.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Foodoogle and its affiliates, personnel, and service providers from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful misuse of the Services, your violation of these Terms, or material you submit that infringes another person’s rights.
Suspension and Termination
You may stop using Foodoogle at any time. We may suspend or terminate access if you materially violate these Terms, create risk or legal exposure, fail to pay applicable fees, or if required by law. Provisions that by their nature should survive termination will remain effective, including ownership, disclaimers, liability limits, indemnification, and dispute provisions.
Governing Law and Disputes
These Terms are governed by applicable laws of the United States, without regard to conflict-of-law principles, while preserving mandatory consumer rights available where you live. Before filing a formal claim, you agree to contact us and make a good-faith effort to resolve the dispute informally. Nothing in these Terms limits rights that cannot lawfully be waived.
Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Services that cannot be resolved informally will be resolved by binding arbitration on an individual basis, rather than in court, under the American Arbitration Association Consumer Arbitration Rules. The arbitrator may award the same individual remedies available in court. You and Foodoogle each waive the right to a jury trial and agree not to bring or participate in any class, collective, consolidated, or representative action or arbitration. This clause does not prevent either party from bringing an eligible individual claim in small claims court or seeking emergency injunctive relief for misuse of intellectual property. You may opt out of this arbitration agreement by notifying us through the Contact or Support page within 30 days after first accepting these Terms and clearly stating your name, account email, and decision to opt out. If applicable law prohibits any part of this section, that part will not apply, and the remainder will continue to the fullest extent permitted by law.
Changes to These Terms
We may update these Terms when the Services, business practices, or legal requirements change. We will post the revised Terms and update the effective date. Where required, we will provide additional notice before material changes take effect. Continued use after updated Terms become effective constitutes acceptance of those changes.
